OC Graniczne (Border Motor Third-Party Liability Insurance)

1. General Information

OC Graniczne is compulsory motor third-party liability insurance intended for vehicles registered outside the European Economic Area entering the territory of countries recognising the compulsory motor liability insurance system.

The insurance applies where there is no valid Green Card international insurance certificate recognised within the European Economic Area.

The product is issued in accordance with Polish legislation governing compulsory motor third-party liability insurance.

2. Purpose of the Insurance

The purpose of OC Graniczne is to ensure mandatory third-party liability insurance coverage for the owner or driver of a motor vehicle.

The insurance is required:

  • when entering the territory of EEA countries;
  • when the vehicle participates in road traffic;
  • in the absence of a valid Green Card.

Participation in road traffic without a valid compulsory insurance agreement is prohibited.

3. What the Insurance Covers

The insurance covers the civil liability of the vehicle owner and/or driver for damage caused to third parties in connection with the use of the vehicle.

Coverage includes:

  • injury to life and health of third parties;
  • bodily injuries;
  • property damage caused to third parties;
  • damage to or destruction of third-party vehicles.

The insurer is liable within the insured limits established by law.

4. What Is Not Covered

The insurance does not cover:

  • damage to the insured’s own vehicle;
  • personal losses of the vehicle owner;
  • environmental damage;
  • cases not предусмотренные by legislation and insurance conditions.

Losses caused to the vehicle owner by the driver of the same vehicle are also excluded from coverage.

5. Limitations of Insurance Coverage

The insurer has the right to seek recovery of paid compensation from the driver in cases provided by law.

In particular, if the driver:

  • intentionally caused the damage;
  • operated the vehicle under the influence of alcohol or narcotic substances;
  • did not possess the required driving licence;
  • unlawfully obtained the vehicle;
  • left the scene of the accident.

6. Territorial Scope

OC Graniczne is valid:

  • in countries of the European Economic Area;
  • in Switzerland;
  • in states whose national bureaus participate in the mutual recognition system for compulsory motor liability insurance.

The exact territorial scope is determined by the insurance policy conditions.

7. Insurance Period

The insurance agreement is concluded for the period specified in the insurance policy.

The agreement may be concluded:

  • for 12 months;
  • or for a shorter period in cases permitted by law.

Insurance coverage begins on the date specified in the policy.

8. Obligations of the Policyholder

The policyholder is required to:

  • provide accurate information when arranging the insurance;
  • pay the insurance premium within the prescribed deadlines;
  • notify the insurer of an insured event;
  • take reasonable measures to minimise the consequences of the incident;
  • notify the police when required;
  • provide other parties involved in the accident with insurance policy details.

9. Termination of the Agreement

The insurance agreement terminates:

  • upon expiry of the insurance period;
  • upon deregistration of the vehicle;
  • upon registration of the vehicle outside the country;
  • in cases of contract termination provided by law.

10. Important Information

  • OC Graniczne is compulsory insurance where no valid Green Card is available.
  • The policy covers only third-party civil liability.
  • The policy does not cover damage to the insured’s own vehicle.
  • Insurance conditions and claims handling procedures are determined by the insurer and applicable legislation.

11. Legal Framework

The product is governed by the legislation of the Republic of Poland concerning compulsory motor third-party liability insurance, as well as by the rules of the international motor insurance recognition system.
